OFFICIAL RULES (“Official Rules”)

NO PURCHASE NECESSARY TO ENTER, WIN OR CLAIM PRIZES. A PURCHASE OR PAYMENT WILL NOT INCREASE AN ENTRANT’S CHANCES OF WINNING. THE CONTEST IS IN NO WAY SPONSORED, ENDORSED, ADMINISTERED BY, OR ASSOCIATED WITH FACEBOOK, INSTAGRAM, OR TWITTER.

THESE OFFICIAL RULES CONTAIN AN ARBITRATION AGREEMENT, WHICH REQUIRES THAT ALL DISPUTES BE RESOLVED SOLELY BY BINDING ARBITRATION, AND ENTRANTS AGREE TO ONLY PURSUE CLAIMS AGAINST SPONSOR AND SPONSOR ENTITIES AND/OR SEEK RELIEF ON AN INDIVIDUAL BASIS, AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT, OR AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.

The Up in Lights Contest (“Contest”) is sponsored by RPI Print, Inc. (“Sponsor”), 116th Street Suite 161, Tukwila, Washington 98168.

1. CONTEST DESCRIPTION: The Contest consists of a submission phase (the “Submission Period”) that begins on or about February 10, 2023, at 12:01 a.m. Pacific Time (“PT”) and ends on March 9, 2023, at 11:59 p.m. PT, followed by a public voting phase (the “Voting Period”) that begins on or about March 10, 2023, at 12:01 a.m. PT and ends on March 19, 2023, at 11:59 p.m. PT.  The Submission Period and the Voting Period are collectively referred to in these Official Rules as the “Contest Period”.  During the Submission Period, entrants will have the opportunity to submit a new book on the Blurb Bookstore (or identify a book entrant published on the Blurb Bookstore after March 10, 2022), as well as the Book cover and representative sample pages from inside the Book, and complete an entry form (each, a “Submission”) that complies with the “Submission Requirements” below, for consideration as more fully set forth below.  Entry in the Contest does not constitute entry into any other promotion, contest, or sweepstakes.  By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor which shall be final and binding in all respects.

2. ELIGIBILITY: This Contest is offered only to individuals who are at least eighteen (18) years old or the age of majority in the entrant’s state of residence, whichever is greater, at the time of entry and are legal residents of the 50 United States or the District of Columbia. Employees of Sponsor, and any of its owners, parent companies, affiliates, directors, subsidiaries, franchisees, representatives, advertising, promotion and production agencies, agents (collectively, the “Contest Entities”) and their immediate family members (i.e., spouse, parent, child, sibling, and the “steps” of each) and persons living in the same household of each (whether related or not) are not eligible to participate in the Contest. Both professionals and amateurs are eligible to participate in this Contest.  All entrants, whether professional or amateur, will compete against each other for the prize based on the same judging criteria. Void where prohibited or restricted by law. All federal, state and local laws apply. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein. Entrants and/or potential winners may be required to provide proof of identification and eligibility as required by Sponsor. If it is discovered or suspected that an entrant has registered or attempted to register for the Contest using multiple identities, all of that entrant’s entries will be declared null and void and any prize such entrant might have been entitled to win will not be awarded to and may be revoked from such entrant. Use of any automated system or any like methods to participate in the Contest is prohibited and will result in disqualification of any entrant attempting such use.

3. HOW TO ENTER: To enter, eligible entrants must: (i) create the book (the “Book”) (ii) during the Submission Period post the Book and representative sample pages from inside the Book on the Blurb Bookstore using directions at https://www.blurb.com/sell-through-blurb (or provide a link to an eligible Book posted there after March 10, 2022); and (iii) visit www.blurb.com/upinlights (the “Website”) and complete and submit the entry form found on the Website with the information and materials requested including an image of the Book’s cover, the Blurb Bookstore link, title, author name, and short summary, and follow the instructions to submit the entry during the Submission Period.  Both the Book and the information and materials submitted during the entry process together constitute the “Submission.” 

SUBMISSION REQUIREMENTS. The Submission must meet the following “Submission Requirements”: (i) the Book must be the entrant’s original work and may not feature or focus on any material owned or controlled by third parties (including without limitation, third party copyrighted material); (ii) the Book must be visually driven (i.e. at least 75% off the book should be photography, illustration, design, comics, etc.) to be determined at Sponsor’s sole discretion; (iii) the Book must be less than two hundred (200) pages in total; (iv) the Book must be entrant’s previously unpublished original work or entrant’s original work that was published only on the Blurb Bookstore and after March 10, 2022; (v) the entrant must have obtained all necessary permissions including intellectual property or likeness and to the extent that are any minors appearing in the Submission, they must have the express permission of the minor’s parents and must be able to provide to Sponsor upon request all appropriate clearances, permissions and releases for the Submission (in the event an entrant cannot provide all appropriate releases required by Sponsor, Sponsor reserves the right, in Sponsor’s sole discretion, to disqualify the applicable Submission, or seek to secure the releases and clearances directly for Sponsor’s benefit, or allow the applicable Submission to remain in the Contest); and (vi) the Submission must comply with the Blurb Terms & Conditions located at https://www.blurb.com/terms, which are incorporated herein by reference.  Without limiting the foregoing, The Submission may not include “Prohibited Content” as defined in Section 11.1 of such Terms & Conditions and must comply with all applicable laws. Limit one (1) Submission per person.  All Submissions must be received by the end of the Submission Period.  No substitutions, updated, edits, or new versions of Submissions will be accepted once the original Submission is submitted for consideration.  Any Submission that is considered by Sponsor in its sole and absolute discretion to violate the Submission Requirements or these Official Rules, in whole or in part, may be disqualified and will not be eligible for entry, and Sponsor may remove any such Submission from the Website. Sponsor reserves the right to remove and/or disqualify any Submission that for which a valid DMCA notice, or other infringement claim is received or if Sponsor reasonably suspects infringement or other violation of these Official Rules.

4. PUBLIC VOTING: Once a Submission is uploaded to the Website it will be made available for viewing by the general public and any such posting will be deemed made at the direction of the entrant. Sponsor will upload each Submission to Website (www.blurb.com/upinlights) under a separate tab titled Vote. Voters will be asked to vote based on entrant’s Book cover, Book title, description, and the entrant’s content available on the landing page at the provided link to the bookstore where there will be more information including and longer description and sample from the inside of the Book (the “Voting Submission”). In order to submit a Voter Submission, voters will need to provide their name and email address.

Public Voting Rules:  Members of the public who are legal residents of and located in the fifty (50) United States of America or the District of Columbia, and who are at least thirteen (13) years old, can cast votes on the Voting Website (“Voters”). During the Voting Period, Voters will have the opportunity to vote on the Voting Submission they believe best demonstrates the following equally weighted criteria: (i) Originality; (ii) Storytelling; (iii) Technical Skill (i.e., demonstrates technical skill in executing the method and medium of the entry).  Any entrant offering or using, or attempting to use a “cheat,” payment, or other incentive may be disqualified and any votes earned by those means will be deemed void if Sponsor so elects in its sole discretion. Limit one (1) vote per person and per IP address per calendar day during the Voting Period. Any suspected or deliberate attempt to manipulate or otherwise fraudulently tamper with the voting process may result in disqualification of any individual or entrant, at the Sponsor’s sole discretion.

Votes generated by script, macro, bot, commercial contest subscription, vote-swapping sites, voting software, entering service sites or any other automated means and votes by any means that subvert the voting process or do not conform to the spirit of these Official Rules will void the applicable votes and may disqualify the applicable entrant. 

If Entrants promote their Submission by posting on social media, all posts must tag @BlurbBooks and use the hashtags #UpInLights and #Contest. If the hashtags are not present, entrant may be disqualified from the Contest. Entrant agrees that if Sponsor requests that they modify or edit their post to include these hashtags, entrant will do so or risk disqualification from the Contest.

Entrants are prohibited from soliciting votes by any fraudulent or inappropriate means, including, without limitation, offering prizes, payments or other inducements to members of the public (including, without limitation, offering to trade votes), as determined by Sponsor in its sole discretion, and all associated votes may be void and such Finalists may be disqualified.  Votes for each Submission may be tracked by the Website.  Any rankings or vote counts posted on the Website are unofficial and should not be relied upon for any purpose.  If attempts are made to vote in excess of the limitations set forth in these Official Rules and/or by means other than as specifically set forth in these Official Rules, Sponsor may, in its sole discretion, disqualify any related Finalist or votes.  In the event that Sponsor determines that the user voting mechanism has been tampered with or otherwise manipulated, Sponsor reserves the right to cancel the voting portion of the Contest or to cancel the Contest, in Sponsor’s discretion.

5. WINNER SELECTION AND NOTIFICATION. Assuming a sufficient number of eligible Submissions are received, at the end of the Submission and Voting Periods, a judge or group of judges selected by Sponsor in its sole discretion (in either case, the “Judging Panel”) will judge the Books entered during the Submission Period.  For avoidance of doubt, the Judging Panel will only review and evaluate the entrant’s submitted Books, and not any other parts of the Submission, except as noted in the Judging Criteria (defined below). Decisions of the Judging Panel are final and not subject to appeal. 

Judging Criteria: The Judging Panel will select one (1) winner based on the following criteria: (i) Originality of the Book (20%); (ii) Storytelling in the Book (20%); (iii) Technical Skill in executing the method and medium of the Book (20%); and (iv) Public Appeal as demonstrated by Public Voting on the Voting Submission (40%) (the “Judging Criteria”). In the event of a tie between two or more entries, the tie will be broken in favor of the tied entrant whose Submission received the highest score for Originality in the initial scoring by the Judging Panel.

The potential winner will be subject to verification and compliance with these Official Rules. The potential winners will be notified via email using the account information used by the entrant to enter the Contest. Sponsor shall have no liability for any winner notification that is lost, intercepted, or not received by a potential winner for any reason.  If, despite reasonable efforts, a potential winner does not respond within the time period specified in the winner notification, or if the prize or winner notification is returned as unclaimed or undeliverable to such potential winner, such potential winner will forfeit his or her prize and an alternate winner may be selected.  If any potential winner is found to be ineligible, or if he or she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential winner will be disqualified, and an alternate winner may be selected. Sponsor may successively attempt to contact up to two (2) potential winners of an applicable prize in accordance with such procedure, and if there is still no confirmed winner of such applicable prize after such attempts have been made, if any, the corresponding prize may go unawarded

6. PRIZE: One (1) Grand Prize is available. The Grand  Prize consists of the author’s book being featured on a digital billboard at the Bird in Times Square which will display the Grand Prize winner’s book cover, name, and web address for approximately 15 seconds at a time on a loop lasting for one (1) week which will play approximately 30 times an hour during the week from April 17, 2023 to April 23, 2023 (Approximate Retail Value (“ARV”) is $8,000.00, as well as a two (2) day/one (1) night trip during the week of April 17, 2023 to April 23, 2023 for the Grand Prize winner to  New York, New York to visit the billboard which includes (i) round-trip coach airfare for the Grand Prize winner between the major airport that is nearest to the Grand Prize winner’s residence and New York, New York (ARV: $700.00); (ii) one (1) night hotel accommodations for the Grand Prize winner at a hotel in New York, New York determined by Sponsor in their sole discretion (ARV: $400.00); and (iii) a meal stipend in the amount of $200.00. The total ARV of the Grand Prize is $9,300.00.

The Grand Prize winner must be at least eighteen (18) years of age or the age of majority in their state of residence, whichever is greater, in order to redeem the Grand Prize and participate in the Grand Prize activities. Grand Prize winner must be able to travel during the week of April 17, 2023 to April 23, 2023 to be eligible to receive the Grand Prize. In the event a Grand Prize winner’s residence is close enough to New York, New York, such that air transportation is deemed by Sponsor in its sole discretion to be unnecessary, the applicable Grand Prize will not include air transportation from such Grand Prize winner’s residence, and Sponsor will instead provide a stipend for ground transportation. The Grand Prize winner must possess all required travel documents, including visas and valid passports, if and as applicable, and comply with any applicable hotel check-in requirements, such as presentation of a major credit card. All aspects of the travel portions of the Grand Prize must be conducted on such dates as determined by Sponsor in its sole discretion. The dates of departure and return are subject to change at Sponsor’s sole discretion. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. Other travel restrictions and blackout dates may apply.  All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes.  The ARV for travel prizes may vary depending upon points of departure and destination and fare fluctuations.  Sponsor reserves the right to structure travel routes and select hotels in its sole discretion.  The ARV for travel prizes is an estimate made before the Contest begins.  The Grand Prize winner will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules.  The roundtrip air transportation element for any travel prize begins and ends at the point of departure.  No interest will be awarded on cash prizes.  Room taxes and other hotel fees are not included and if applicable may be payable at the time of check-out by the winner.  A deposit or payment in advance, or presentation of a credit card by the Grand Prize winner, may be required at the time of check-in at the hotel.  Any hotel cancellations or changes to hotel reservations after confirmation must be made with the hotel directly, and the Grand Prize winner is solely responsible for any charges and/or fees arising from changes made directly with the hotel.  The prize restrictions/conditions stated herein are not all-inclusive and the Grand Prize described above may be subject to additional restrictions/conditions, which may be stated in the Affidavit (as defined below) and/or other travel documents.  In the event the Grand Prize winner engages in behavior that, as determined by Sponsor in its sole discretion, is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send the Grand Prize winner home with no further compensation.  The Submission Requirements also apply to any content the Grand Prize winner provides for the billboard portion of the Grand Prize.  In the event any billboard content provided by the Grand Prize winner violates any of the Submission Requirements, these Official Rules,  the rights of any third party, or the law, in whole or in part, or if Sponsor reasonably suspects such a violation, or if any valid DMCA notice or other infringement notice or claim is received, Sponsor may immediately and without notice remove some or all of the billboard display, and is under no obligation to replace it with any content related to Grand Prize winner or Grand Prize winner’s Book or the Submission, and the Grand Prize winner will not receive cash or any other form of compensation in such event.  All expenses and incidental travel costs not expressly stated in the Grand Prize description above, including but not limited to, ground transportation, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes, gratuity or other expenses are the sole responsibility of the Grand Prize winner.

Before being declared a winner the potential winner may be required to execute an Affidavit of Eligibility, Liability Release, tax acknowledgment, and, except where prohibited, a Publicity Release (“Affidavit”). If requested by Sponsor, the potential Grand Prize winner must return a fully executed Affidavit to the Sponsor or its authorized designee within seven (7) calendar days from the date it is sent to the potential winner or the Grand Prize may (in Sponsor’s sole discretion) be forfeited. If a potential winner is disqualified, found to be ineligible or not in compliance with these Official Rules, declines to accept a prize, or in the event that the potential winner fails to return an executed Affidavit within the seven (7) calendar day deadline (if applicable), the Prize may be forfeited. If the Prize is forfeited, the Prize may be awarded to an alternate winner, who will selected by calculating the second highest score using the Judging Criteria from the eligible remaining Submissions. Sponsor shall not be held responsible for any delays in awarding a prize for any reason. If, after three (3) good faith attempts to award the Prize to potential winners, Sponsor is unable to award the Grand Prize, the prize may not be awarded.

ALL FEDERAL, STATE AND LOCAL TAXES IMPOSED ON THE ACCEPTANCE OF A PRIZE ARE SOLELY THE RESPONSIBILITY OF WINNER.  Any person winning $600 or more worth of prizes from Sponsor in a calendar year will receive an IRS form 1099 after the end of the calendar year in which the prizes were awarded, and copy of such form will be filed with the Internal Revenue Service (IRS).

7. LIMITATION OF LIABILITY: By participating in this Contest entrants agree that the Contest Entities, and their respective affiliates, parents, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, Web masters and their respective officers, directors, employees, representatives, shareholders, designees and agents (“Released Parties”) are not responsible for lost, late, incomplete, stolen, misdirected, postage due, or undeliverable notifications or mail; or for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections or availability; or garbled, corrupt or jumbled transmissions, service provider/Internet/website/use net accessibility, availability or traffic congestion; or any technical, mechanical, printing, or typographical or other error; or unauthorized human intervention; or the loss, access, or acquisition without authorization, or incorrect or inaccurate capture of registration information; or the failure to capture, or loss or disclosure of, any such information. The Released Parties are not responsible for any incorrect or inaccurate information, whether caused by any website users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Contest and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access or acquisition of the website, any Contest-related website(s), or entrant information. The Released Parties are not responsible for any injury or damage, whether personal or property, to participants or to any person’s computer related to or resulting from participating in the Contest and/or accepting or using a prize. The Released Parties shall not be responsible or liable for entries that are entered by any automated computer, program, mechanism or device, for any entries in excess of the stated limit or for entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, garbled or otherwise not in compliance with the Official Rules, and all such entries may, in Sponsor’s sole discretion, be disqualified. If, for any reason, the Contest is not capable of running as planned, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest and/or proceed with the Contest, including the selection of winners in a manner it deems fair and reasonable including the selection of the winners from among eligible Entries received prior to such cancellation, termination, modification or suspension. In no event will more prizes be awarded than are stated in these Official Rules. If for any reason, including but not limited to an administrative, printing, production, computer or other error or due to technical difficulties or incorrect announcements of any kind, more winning messages are distributed, or more prizes are claimed than are intended to be awarded according to these Official Rules, the intended prizes will be awarded among all verified prize claims received based on the judging criteria stated in these Official Rules. This Contest is subject to all federal, state, and local laws and regulations.

By entering the Contest, each entrant agrees: (i) to be bound by these Official Rules and by all applicable laws and by the decisions of Sponsor, which shall be binding and final; (ii) to waive any rights to claim ambiguity with respect to these Official Rules; (iii) to waive all of his or her rights to bring any claim, action or proceeding against any of the Released Parties in connection with the Contest; and (iv) to forever and irrevocably agree to release and hold harmless each of the Released Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines, penalties, liability, costs and expenses (including, without limitation, reasonable outside attorneys’ fees) that may arise in connection with: (a) the Contest, including but not limited to any Contest-related activity or element thereof, and the entrant’s Submission, including any information provided, participation or inability to participate in the Contest, (b) the violation of any third-party privacy, data security, personal, publicity or proprietary rights, (c) typographical or printing errors in these Official Rules or any Contest materials, (d) acceptance, attendance at, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of a prize (or any component thereof), (e) any change in the prizing due to unavailability or due to reasons beyond Sponsor’s control, including but not limited to by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not such action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened or actual terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot or any other cause beyond any of the Released Parties’ control, or as otherwise permitted in these Official Rules, (f) any interruptions in or postponement, cancellation or modification of the Contest, (g) human error, (h) incorrect, unauthorized, or inaccurate transcription, receipt or transmission of any part of any Entry , (i) any technical malfunctions or unavailability of the website or any telephone network, computer system, computer online system, mobile device, computer timing and/or dating mechanism, computer equipment, software, or Internet service provider, or mail service utilized by any of the Released Parties or by an entrant, (j) interruption or inability to access the Contest, the website or any other Contest-related websites or any online service via the Internet due to hardware or software compatibility problems, (k) any damage to entrant’s (or any third person’s) equipment used to access the Contest and/or its contents related to or resulting from any part of the Contest, (l) any lost/delayed data transmissions, omissions, interruptions, defects, and/or any other errors or malfunctions, (m) any late, lost, stolen, mutilated, misdirected, delayed, garbled, corrupted, destroyed, incomplete, undeliverable or damaged Entries, (n) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties, (o) lost, late, stolen, misdirected, damaged or destroyed prizing (or any element thereof), or (p) the negligence or willful misconduct by entrant.

Without limiting the foregoing, everything regarding this Contest, including the website and prize components, are provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow the limitations or exclusions of liability for incidental or consequential damages or exclusions of implied warranties, so some of the above limitations or exclusions may not apply. Check local laws for any restrictions or limitations regarding these limitations or exclusions.

8. RIGHTS IN AND PERMISSION TO USE SUBMISSIONS:  For good and valuable consideration, the receipt and legal sufficiency of which is hereby acknowledged, each entrant hereby irrevocably grants to the Contest Entities, and their successors, licensees and assigns, a non-exclusive, worldwide, fully-paid, and royalty-free license to reproduce, distribute, publicly display, use, and otherwise make available the Book and the Submission in connection with promoting, marketing, and administering the Contest and, for the winning Book, for the purposes of preparing the billboard content as part of the prize. Entrant hereby irrevocably grants to the Contest Entities, and their successors, licensees and assigns, a non-exclusive license (but not the obligation) to reproduce, publicly perform, publicly display, stream, exploit, make derivative works of and otherwise use the Book cover, summary of the Book, excerpts from the Book, and other information and materials from the Submission, in whole or in part, for promoting, marketing, and administering the Contest as well as for the advertising, marketing, and promoting of RPI and its products and services and, as to the winning Book, for the purposes of preparing the billboard content as part of the prize for any purpose, including without limitation commercial purposes, in any and all media now or hereafter devised throughout the universe in perpetuity.  The Contest Entities shall retain the rights granted in each Submission even if the Submission is disqualified or fails to meet the Submission Requirements or even if it determined that the entrant who made the Submission is ineligible to enter the Contest.

9. NO OBLIGATION TO USE:  The Contest Entities shall have no obligation (express or implied) to use any Submission, or to otherwise exploit any Submission or, if commenced, to continue the distribution or exploitation thereof, and the Contest Entities may at any time abandon the use of the Submission for any reason, with or without legal justification or excuse, and entrants shall not be entitled to any damages or other relief by reason thereof.

10. DATES & DEADLINES/ANTICIPATED NUMBER OF CONTESTANTS:  Because of the unique nature and scope of the Contest, Sponsor reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Official Rules or otherwise governing the Contest.  Sponsor cannot accurately predict the number of entrants who will participate in the Contest.

11. FURTHER DOCUMENTATION: If Sponsor shall desire to secure additional licenses, permissions, or waivers, for the Submission or other documents as Sponsor may reasonably require in order to effectuate the purposes and intents of these Official Rules, then each entrant agrees to sign the same upon Sponsor’s request therefor.

12. DISPUTE RESOLUTION AND ARBITRATION; CLASS ACTION WAIVER: This Contest is governed by, and will be construed in accordance with, the laws of the state of Washington without regard to any choice of law or conflicts of law rules, and the forum and venue for any dispute shall be in Seattle, Washington.

ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE SWEEPSTAKES OR THESE OFFICIAL RULES SHALL BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“AAA RULES”). THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL OR INCIDENTAL  DAMAGES OR HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.

ENTRANTS AGREE THAT THE ARBITRATION OF DISPUTES PURSUANT TO THIS SECTION SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

ENTRANTS AGREE THAT THE RIGHTS AND OBLIGATIONS OF ANY ENTRANT AND/OR CONTEST ENTITIES AND/OR ANY OTHER PARTY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT, OR AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION OR PROCEEDING.

ANY DEMAND FOR ARBITRATION MUST BE FILED WITHIN ONE (1) YEAR FROM THE END OF THE CONTEST PERIOD, OR THE CAUSE OF ACTION SHALL BE FOREVER BARRED.

13. PRIVACY POLICY: Any information collected during an entrant’s participation in the Contest will be collected by Sponsor or designee and used by Sponsor, affiliates, designees, agents, and marketers for purposes of the proper administration and fulfillment of the Contest and as described in these Official Rules and in accordance with Sponsor’s Privacy Policy as stated at https://www.blurb.com/privacy.

14. PUBLICITY RIGHTS: By participating in the Contest and/or accepting a prize, each entrant grants Sponsor and Sponsor’s designee the perpetual right to use his or her name, social media user name (handle), biographical information, photos and/or likeness, and statements for Contest, trade, commercial, advertising and publicity purposes on a worldwide basis, at any time or times, in all media now known or hereafter discovered including without limitation live television, social media, and on the World Wide Web and Internet, without notice, review or approval and without additional compensation, except where prohibited by law.

15. GENERAL: Any attempted form of participation in this Contest other than as described herein is void. If it is discovered or suspected in Sponsor’s sole and absolute discretion that an entrant has registered or attempted to register more than once using multiple email addresses, accounts, multiple identities, proxy servers or like methods, all of that entrant’s entries will be declared null and void, and that Entrant will be ineligible to win a prize. Also, if it is discovered that any entrant attempts to receive additional entries in excess of the stated limitation, that entrant may, in Sponsor’s sole discretion, be disqualified from the Contest. Sponsor reserves the right to disqualify any individual found, in its sole opinion, to be tampering with the operation of the Contest, to be acting in violation of these Official Rules or to be acting in an unsportsmanlike manner or with the intent to disrupt the normal operation of a Contest. Any use of robotic, automatic, macro, programmed, third party or like methods to participate in the Contest will void any attempted participation affected by such methods and the disqualification of the individual utilizing the same. CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. If any provision of these Official Rules or any word, phrase, clause, sentence, or other portion thereof should be held unenforceable or invalid for any reason, then that provision or portion thereof shall be modified or deleted in such manner as to render the remaining provisions of these Official Rules valid and enforceable. The invalidity or unenforceability of any provision of these Official Rules or the prize documents will not affect the validity or enforceability of any other provision. Sponsor’s interpretation of these Official Rules is final and binding in all matters related to the Contest. Sponsor or Released Partiess’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision and such provision shall remain in full force and effect. All Submissions and/or all electronic files submitted become the property of Sponsor and will not be returned. In the event of any conflict with any Contest details contained in these Official Rules and Contest details contained in any promotional materials (including but not limited to point of sale, television and print advertising, promotional packaging, social media, email communications, and other promotional media), the details of the Contest as set forth in these Official Rules shall prevail.

16. SOCIAL MEDIA RELEASE AND DISCLAIMER. Each entrant acknowledges and agrees that this Contest is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram, or Twitter. By entering the Contest each entrant hereby releases and agrees to hold harmless these entities completely from any liability in connection with the Contest. Any questions, comments or complaints regarding the Contest should be directed to Sponsor and not these social media platforms. By participating via any applicable social media platform, Entrants are also subject to such platform’s terms of use.

17. TO RECEIVE WINNERS LIST OR OFFICIAL RULES: The Official Rules (available during the Contest Period) and Winners List (available after winner is confirmed) will be available on Blurb.com for a period of sixty (60) days after the close of the Contest Period.
